All compensation is obtained from the insurer
Although it is possible to recover damages amicably from the person responsible for the accident – especially in the case of minor accidents – in most cases you will obtain all compensation from the insurer of the guilty party, under the terms of their motor vehicle liability insurance (RCA).
Thus, you do not have to worry that the guilty party will not have the money to cover the damage. Their insurance policy has a maximum limit set by law, which will always be more than enough to compensate you fully, for all the expenses you have incurred and not only.
In this sense, the compensation is not limited to the full repair of your vehicle, but also includes damages for hospitalization, if any, damages for days not worked, for towing your vehicle, and for the loss of use of it.
